Terms of Service

These Terms of Service ("Terms") govern your use of brokerlumen.com, the BrokerLumen portal at app.brokerlumen.com, and any kits, services, or plans you buy. BrokerLumen is operated by Scott Yale, a sole proprietor ("BrokerLumen," "we," "us"). By using the site or portal or buying from us, you agree to these Terms. If you accept them for a company, you confirm you may bind that company.
Services
BrokerLumen provides AI governance and automation services for mortgage brokers, including:
- Kits: the Starter, Policy Kit, and Team Kit templates and policy frameworks (digital downloads)
- Done-for-you services: such as Done-For-You governance and Growth Stack setup, scoped in a written proposal
- The portal: a web app for tracking AI policy acknowledgments, offered on a Free plan and on paid monthly or annual plans
Not legal advice
BrokerLumen is not a law firm and does not provide legal advice. Our templates, frameworks, portal, and services are general business and technical resources. You are responsible for your own regulatory obligations, and we recommend that qualified legal counsel review any policy before you adopt it.
Your responsibilities
- Provide accurate, complete information and timely access needed to deliver services
- Do not send us or upload borrower or consumer loan data
- Review, adapt, and approve all deliverables before use in your business
- Use the site, portal, and services lawfully
Portal accounts
- Company administrators control who is added to the portal and are responsible for having the right to enter their team members' information and for telling them how it is used.
- Keep sign-in details secure and tell us promptly at [email protected] if you suspect unauthorized access.
- Each plan has a user (seat) limit. Active and invited people count toward it; deactivated and archived people do not. To add people beyond your limit, move to a larger plan.
- Your company owns the data it enters. We process it only to provide and support the portal, as described in our Privacy Policy.
- You may export your records at any time while your account is open. We may suspend accounts that are used unlawfully or that put the service or other customers at risk.
Data processing
For portal data your company enters about its team members, your company decides what is collected and why, and BrokerLumen acts as its service provider. We will: process that data only to provide, secure, and support the portal and as your company instructs; not sell or share it, or use it for our own marketing or to train AI models; limit access to what is needed to run the service; use only the service providers listed in our Privacy Policy, under obligations to protect the data; help your company respond to requests from its team members; notify your company without undue delay if we confirm a security breach affecting its data; and delete or return the data when your account closes, as described in our Privacy Policy. Payment, plans, and automatic renewal
Payments are processed by Stripe. Prices are shown on the site or in your written proposal and are in US dollars, plus any applicable tax.
- Paid portal plans renew automatically at the end of each billing period (monthly or annual) at the then-current price until you cancel. You authorize us, through Stripe, to charge your payment method for each renewal. We show the renewal terms before you check out and send a confirmation by email.
- Cancel online anytime from the Billing page in the portal or by emailing [email protected]. Cancellation stops future renewals and takes effect at the end of the current billing period; your company keeps access until then and then moves to the Free plan, with nothing deleted.
- For annual plans, we will email a reminder before each renewal. If we change a plan's price, we will tell you by email before it applies to your next renewal.
- Kits are one-time purchases. Done-for-you services are billed as described in your written proposal.
Refund policy
Everything we sell comes with a 14-day refund window. If you are not satisfied, email [email protected] within 14 days of the charge and we will refund it in full. This applies to:
- Kits (Starter, Policy Kit, and Team Kit)
- Done-For-You and Growth Stack setup fees and services
- Portal plans, monthly or annual, including each renewal charge
We do not give refunds after 14 days, including for partial billing periods. You can still cancel a plan at any time to stop future renewals.
Intellectual property and license
BrokerLumen keeps all rights in its templates, frameworks, portal, and materials. When you pay, you receive a non-exclusive, non-transferable license to use and adapt the materials for internal use within your company. You may not resell, sublicense, redistribute, or publish them, or use them to provide services to others. If you receive a refund, the license for the refunded materials ends.
Disclaimer
The site, portal, and services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee any regulatory, audit, or business outcome, or that the portal will be uninterrupted or error free.
Limitation of liability
To the fullest extent permitted by law, BrokerLumen will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us for the services giving rise to the claim in the 12 months before it arose.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict of law rules. Any dispute will be brought exclusively in the state or federal courts located in San Diego County, California.
Changes
We may update these Terms. Changes take effect when posted here with a new effective date. If a change is significant, we will tell portal account administrators by email. Written proposals you have signed continue to govern their engagements.
